The short answer
Aviator is supplied by Spribe to licensed operators. The licence is the operator’s. If the operator holds a Kenyan licence and you are 18 or over, playing is legal. That is why the comparison page puts licence transparency first and why SportPesa, which prints BK 0001193 on its site, ranks at the top.
What changed in 2025
The Gambling Control Act 2025 was enacted on 7 August 2025 and came into force on 26 August 2025, replacing the Betting, Lotteries and Gaming Act of 1966. The changes that matter to a player:
- New regulator. The Gambling Regulatory Authority replaces the BCLB; a Gambling Appeals Tribunal hears disputes.
- Online licences. Separate categories for online bookmakers, lotteries and casinos. Online operators must run an approved control system covering security, payments, age verification, responsible advertising, anti-money-laundering and data protection.
- 36-month licences instead of annual ones.
- Advertising rules in law. No celebrities, influencers or content creators; no portrayal of gambling as a path to wealth; at least 20% of any advertisement for responsible-gambling messaging; licence number and an addiction warning on all promotional material; pre-approval by the regulator and the Kenya Film Classification Board.
Five sets of 2026 regulations operationalise the Act, including rules for foreign-based operators and advertising.
What it means at the operator
- Deposit limits and self-exclusion must be offered.
- Age verification is mandatory.
- The licence number should be printed on the site; formats like BK 0001193 (bookmaker) and PG 0000452 (public gaming) continue until renewal.
- Unresolved disputes can go to the Gambling Appeals Tribunal.
Verifying a licence
- Footer of the operator’s site or app.
- Note the licence number and company name.
- Check them on the regulator’s register at gra.go.ke.
- “Licensed and regulated” with no number means unlicensed until proven otherwise.
Offshore operators
1xBet, 22Bet and Betwinner serve Kenyan players; 1xBet and 22Bet state Kenyan licences. Check the numbers yourself. If an operator is not on the register, you have no Kenyan consumer protection, no Appeals Tribunal, your own tax exposure and payment routes that change without notice. The 1xBet page sets it out.
Taxes
- Withholding tax on winnings: 20%, deducted by licensed operators at the point of winning.
- Excise duty on stakes, deducted at the point of betting; the rate is set by the Finance Act.
Not legal advice
We are players and reviewers. The Act, the 2026 regulations and the regulator’s notices are the primary sources; for a dispute, the Gambling Appeals Tribunal and a Kenyan advocate are the right route.
Frequently asked questions
What is the legal gambling age in Kenya?
18. Operators must verify age and may not market to minors.
Who regulates betting in Kenya?
The Gambling Regulatory Authority (GRA), created by the Gambling Control Act 2025, which replaced the Betting Control and Licensing Board (BCLB). BCLB-era licence numbers (BK 0001193 and similar) remain valid until renewal.
Is it illegal to play Aviator on 1xBet or Betwinner?
The law regulates operators rather than players, and the 2026 Foreign-Based Operators Regulations set out how foreign operators are expected to be licensed. The practical consequence for a player is that Kenyan consumer protection and the Gambling Appeals Tribunal do not apply to an unlicensed operator.
Are Aviator winnings taxed?
Yes. 20% withholding tax on winnings, deducted by licensed operators when the win lands, plus excise duty on stakes deducted when you bet.
